Terms of Service

By accessing or using the service provided by Forge Ventures, operating as FuelTheGains ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to update these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

To access certain features, you must create an account by providing accurate and complete information. You may register using your email address or through Google OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

FuelTheGains offers both free and premium subscription plans. Premium features, including personalized meal plan generation and progress tracking, require a paid subscription at $9/month (or $5/month for the first 20 early-adopter subscribers, while that tier is available). Forge Ventures operates under the French micro-entreprise VAT exemption ("TVA non applicable, art. 293 B du Code général des impôts"); prices are shown in USD, all taxes included where applicable.

• All payments are processed securely through Stripe.
• Subscriptions renew automatically each billing cycle unless cancelled.
• You may cancel your subscription at any time through your account settings or the Stripe billing portal. Cancellation takes effect at the end of the current billing period.
• Refunds are handled on a case-by-case basis. Contact support for assistance.
• Right of withdrawal (EU consumers): under French Consumer Code Art. L.221-28 13°, the 14-day right of withdrawal does NOT apply to digital content supplied immediately upon payment — by confirming your subscription, you expressly request immediate access and acknowledge that you waive this right. You can still cancel renewals at any time under item 3.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data including biometric information. By using the Service, you consent to the practices described in the Privacy Policy.

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Impersonate any person or entity, or misrepresent your affiliation.
• Attempt to gain unauthorized access to the Service or its related systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Use automated means to access the Service without our prior written consent.
• Distribute harmful software or malicious code.

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, algorithms, and software — are the exclusive property of Forge Ventures and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

To the fullest extent permitted by law, Forge Ventures and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time by contacting support.

These Terms are governed by French law. Before any litigation, EU consumers are invited to contact us at support@resend.fuelthegains.com so we can attempt an amicable resolution. If no agreement is reached, EU residents may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Any disputes that cannot be resolved amicably are subject to the exclusive jurisdiction of the courts of Paris, France — without prejudice to mandatory consumer-protection provisions of the consumer's country of residence.
